SWAP Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions govern your use of SWAP. By creating an account, signing in, browsing listings, posting content, sending messages, or using any SWAP feature, you agree to these Terms. If you do not agree, do not use SWAP.

2. About SWAP

SWAP is a user-to-user marketplace app for giving away or swapping items. SWAP helps users create listings, browse items, chat, complete exchanges, and leave feedback. VA Solutions LLC provides the platform. Users are responsible for the items they list, the accuracy of their content, and their interactions with other users.

3. Eligibility

• You must be at least 18 years old.
• You must provide accurate account and profile information.
• You must use SWAP only for lawful purposes.
• You must not use SWAP if you are legally barred from doing so.

4. Accounts and Security

You are responsible for your account activity and for keeping your device and sign-in method secure. Tell us at once if you believe your account has been used without permission. We may suspend or close accounts that violate these Terms, create risk, or appear fraudulent.

5. Listings

When you create a listing, you agree that:

• You have the right to offer the item.
• The listing is accurate, complete, and not misleading.
• Photos show the actual item or clearly represent it.
• The item category, condition, and location are accurate.
• You will remove or update listings that are no longer available.

6. Prohibited Items and Content

You must not list, request, trade, give away, promote, or discuss transactions involving:

• Illegal goods or services.
• Weapons, ammunition, explosives, or regulated weapon accessories.
• Drugs, controlled substances, prescription medication, or drug paraphernalia.
• Pornographic, sexually explicit, exploitative, or abusive content.
• Stolen, counterfeit, unsafe, recalled, or restricted goods.
• Hate, harassment, threats, scams, spam, or deceptive content.
• Personal data of another person without permission.
• Any item or activity that violates applicable law or these Terms.

7. Moderation

SWAP may review listings, photos, messages, reports, and account activity. We may use automated tools, keyword rules, third-party moderation services, and manual review. We may reject, hide, archive, delete, or hold content for verification. We may also restrict, suspend, or terminate accounts.

Moderation is not a guarantee that all unsafe, illegal, or inaccurate content will be detected. Users remain responsible for their own content and actions.

8. User Interactions and Exchanges

SWAP does not own, inspect, deliver, insure, or guarantee listed items. Exchanges are made directly between users. You are responsible for checking the item, deciding whether to proceed, arranging a safe meeting or delivery method, and complying with local law.

• Meet in safe public places where practical.
• Do not share sensitive personal or financial information in chat.
• Do not send money or valuables unless you fully understand and accept the risk.
• Report suspicious listings, messages, or users through the app or by email.

9. Chat, Reviews, and Feedback

You may use chat to discuss listings and exchanges. You must not harass, threaten, spam, scam, or abuse other users. Reviews and ratings must be based on real interactions and must not be fake, paid, retaliatory, or misleading.

10. User Content License

You keep ownership of content you submit to SWAP. You give VA Solutions LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt, moderate, and distribute your content as needed to operate, improve, promote, secure, and enforce SWAP. This license ends when your content is deleted, except where continued use is needed for backups, legal compliance, dispute handling, safety, or enforcement.

11. Privacy

Our Privacy Policy explains how we collect, use, share, and protect personal information. By using SWAP, you acknowledge that your information will be handled as described in the Privacy Policy.

12. Notifications

SWAP may send service notifications about account activity, messages, listings, moderation, and safety. Push notifications require device permission and can be disabled in device settings.

13. App Availability and Changes

We may change, suspend, or discontinue parts of SWAP at any time. We may release updates, add or remove features, or change how moderation, listings, chat, notifications, or profiles work. We do not guarantee uninterrupted or error-free service.

14. Fees and Payments

Unless SWAP introduces paid features in the future, the app does not process marketplace payments between users. If paid features are added, additional terms may apply. Users are responsible for any taxes or legal duties related to their exchanges.

15. Account Deletion and Termination

You may request account deletion through the app where available. We may suspend or terminate your account if you violate these Terms, create legal or safety risk, abuse the platform, or use SWAP in a way that harms other users or the service.

After account deletion or termination, some information may remain where required for legal, security, backup, fraud-prevention, or dispute-resolution reasons.

16. Disclaimers

SWAP is provided on an 'as is' and 'as available' basis. To the maximum extent allowed by law, VA Solutions LLC disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

17. Limitation of Liability

To the maximum extent allowed by law, VA Solutions LLC will not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages, or for disputes, losses, injuries, or damages arising from user listings, user content, user meetings, item quality, item legality, or user conduct.

Nothing in these Terms limits liability that cannot be limited under applicable law.

18. Indemnity

You agree to defend and hold harmless VA Solutions LLC from claims, losses, liabilities, damages, costs, and expenses arising from your content, your use of SWAP, your exchanges with other users, or your violation of these Terms or applicable law.

19. Governing Law and Disputes

These Terms are governed by the laws of Georgia, unless mandatory consumer protection law in your country or region requires otherwise. The courts of Tbilisi, Georgia will have jurisdiction where permitted by law. If you are a consumer in a country with mandatory local consumer rights, those rights are not limited by these Terms.

20. Changes to These Terms

We may update these Terms. If changes are material, we will provide notice through the app or another reasonable method. Continued use of SWAP after the updated Terms become effective means you accept the updated Terms.
